By signing this Agreement, you agree to work with the New York State Energy Research and Development Authority (NYSERDA) towards continuous improvement of energy management at (facility/participant), located at (address), in accordance with PON 4371 and the criteria listed below. In return, NYSERDA will provide a series of trainings on Strategic Energy Management (SEM) along with technical assistance, at no cost to the Participant, to support implementation of SEM.
All terms not defined within this agreement are defined in PON 4371. With the support of NYSERDA and the Energy Coach, the Participant agrees to the conditions outlined below.
The Participant will designate staff to integrate SEM into its business processes. This includes identifying an Executive Sponsor, an Energy Champion, and creating an Energy Team, to provide input and disseminate information to staff.
The Participant commits to participation in the SEM program. This includes attending and taking action on all training sessions, sharing lessons learned from the trainings with the Energy Team and facility staff, and submitting deliverables to NYSERDA and the Energy Coach for review and approval.
The Participant will provide necessary information to NYSERDA and the Energy Coach including appropriate energy use and energy driver data, and relevant energy, sustainability, or regulatory KPIs for the facility to aid in the creation and maintenance of an energy model.
I agree to and authorize the sharing of the participant-customer’s information and/or project-level information with New York State Department of Public Service Staff and appropriate local utility, including its agents or authorized representatives, in carrying out its responsibilities under New York State Public Service Commission orders. (For clarity, the term project level includes the information based on the scope of the project, including, but not limited to, whole building, building or subsets of the project.
I agree and authorize our utility’s sharing of the participant-customer’s information and/or project-level information with New York State Department of Public Service Staff and NYSERDA, including its agents or authorized representatives, consistent with NYSERDA’s New York State Public Service Commission and statutorily authorized responsibilities, including, but not limited to supporting market development initiatives, and other evaluation and measurement activities. (For clarity, the term project level includes the information based on the scope of the project, including, but not limited to, aggregated and anonymized whole building, building or subsets of the project.)
